In consideration of the services provided by PICKUPDOTEARTH, LLC, otherwise referred to as Pickup.Earth, and being allowed to participate (in any way, shape, or form) in any game or event affiliated with Pickup.Earth, I understand, acknowledge, and agree to the following:
- Physical Fitness Certification: I certify that I am physically fit and able to participate in the program, event, or activity, and have not been advised otherwise by a qualified medical professional. I understand that participation is voluntary and that I am responsible for my own health and safety during participation.
- Assumption of Risks: I will be engaging in activities that involve the risk of serious injury, including permanent paralysis and death, and severe social and economic losses, which might result not only from my own actions, inactions, or negligence but also from the actions, inactions, or negligence of others (including Pickup.Earth), the rules of play, or the condition of the premises or any equipment used. In addition, there may be other risks not known to us or not reasonably foreseeable at this time. I understand and assume all such risks.
- Inspection of Facilities and Equipment: Prior to my participation in any game or event affiliated with Pickup.Earth in any way, I will inspect the facilities and equipment being used. If I believe they may be unsafe, I will immediately notify Pickup.Earth personnel of such condition and will refuse to participate until the issue is remedied.
- Release and Waiver of Liability: I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release, waive, discharge, and covenant not to sue PICKUPDOTEARTH, LLC, their respective affiliated entities and organizations, and their respective directors, commissioners, referees, employees, agents, facilities, and sponsors (the “Representatives”) from any and all claims, demands, losses, or damages on account of injury, including death or damage to property, caused or alleged to be caused in whole or in part by the negligence of Pickup.Earth or the Representatives.
- Indemnification: I agree to indemnify, defend, and hold the Releasees harmless from and against any and all claims for damages, injuries, losses, liabilities, and expenses relating to, resulting from, or arising out of my participation in any Pickup.Earth activity, including legal fees incurred by Pickup.Earth.
- Consent to Medical Treatment: I consent to have medical treatment that may be deemed advisable in the event of injury, accident, and/or illness during any program, event, or activity. I release PICKUPDOTEARTH, LLC, and all persons participating in any such medical treatment from all responsibility for any such actions.
- Use of Likeness: I grant Pickup.Earth the right to use any photographs, video recordings, or other media taken of me during the event for promotional, marketing, or any other purpose, without compensation or prior notice.
- Acknowledgment of Rules and Regulations: I acknowledge that I have read and understood all the rules and regulations of Pickup.Earth, and I agree to abide by them. I understand that failure to comply with these rules may result in my removal from the activity without refund.
- Severability: If any provision of this Waiver and Release of Liability is found to be unenforceable or invalid, that provision shall be severed from this document, and the remaining provisions shall remain in full force and effect.
- Governing Law: This Waiver and Release of Liability shall be governed by and construed in accordance with the laws of the state in which the event takes place.
BY SIGNING, I AGREE TO THE TERMS & CONDITIONS OF THIS PARTICIPATION WAIVER.
